Professional Pet Transports Contract, Terms and Conditions
I. General: ____________ (Initial)
In order for Professional Pet Transports Inc. to process your order you must READ AND AGREE TO THE FOLLOWING TERMS AND CONDITIONS. Please be sure to initial each section herein to acknowledge your understanding and agreement. Upon receipt of your order, you will be sent a copy of your invoice along with general information about transporting your pet and an Emergency Care Authorization form. A signed copy of both the Terms & Conditions form and Emergency Care Authorization form must be received in our office prior to transport. If you are sending multiple animals, they may all be listed on a single form. This form gives us permission to take your animal to a veterinarian in the event they become ill during a transport. EVERY PET MUST HAVE A VALID INTERSTATE HEALTH CERTIFICATE ISSUED NO SOONER THAN TEN DAYS BEFORE THE COMMENCEMENT OF THE SCHEDULED TRANSPORT WITH THE EXCEPTION OF FISH, REPTILES AND RODENTS.
II. Payment: ____________ (Initial)
Full payment is required prior to transport, unless you have made arrangements to pay by COD. If you are paying by COD, a credit card will also be required so as to cover the costs of transport (but will only be charged in the event of failure to pay for services rendered). There will be an additional charge of $2.50 for each incorrect billing address submitted. FOR CREDIT CARD PAYMENTS, BY INDICATING YOUR AGREEMENT HERE OR BY OTHER MEANS, YOU CONSENT THAT YOUR CREDIT CARD IS TO BE CHARGED ACCORDING TO THESE TERMS, CONDITIONS AND RATES. YOU ALSO ACKNOWLEDGE THAT ANY ATTEMPT TO CANCEL PAYMENT DURING OR AFTER SERVICES HAVE BEEN RENDERED, ACCORDING TO THESE TERMS AND CONDITIONS CONSTITUTES THEFT OF SERVICES. If you are sending a money order, it must be received no later than seven days prior to scheduled transport.
III. Pick-up and Delivery: ____________ (Initial)
Dates and times of Pickup and Delivery: It is understood that at no point during the scheduling of a transport is a specific date and time given for pickup or delivery of an animal. We will only state the week of the transport until the transport is actually routed. At that point, we will give our estimated pickup and delivery dates. Times for pickup and delivery are estimated to be within a 24 hour period before or after pickup and delivery dates. It is further understood that these are solely estimates. There are unforeseeable factors which can and do influence the times given for a transport such as: weather, road conditions, and the care of pets which have special needs. (See also section IV. Transport Duration). Also, if it is necessary for our transport vehicle to pick up or deliver your pet 20 miles or more off the Interstate, it is understood that there will be an additional $3.00 charge per mile (beginning at the Interstate).
Sending Animals: IF NO PERSON IS PRESENT TO SEND animals scheduled for transport and/or we are unable to contact the responsible party, the drivers/attendants will continue the transport without your animals. You will then be charged for the full transport cost, less insurance and carrier rental fees. We recommend that you make alternate arrangements in case the person responsible for sending the animals is unable to do so.
Receiving Animals: IF NO ONE IS AVAILABLE TO RECEIVE the animals and/or we are unable to contact the responsible party there will be a daily $100 fee per animal to defray the cost of care and boarding. The party who ordered the transport will be responsible for these extra charges. It is highly recommended that alternate arrangements be made in case the person responsible for receiving the animals is unable to do so. If you use a kennel or other boarding facility, it will be your responsibility to make sure they are aware that we may arrive outside of regular business hours so that they can accommodate our schedule.
IV. Transport Duration: ____________ (Initial)
It is understood that there is no guarantee, nor has any promise been made that there will be a specified duration or length of time for any given transport. The length of the transport of your pet/s is determined by routing, weather and/or traffic conditions and other factors during any given transport and may potentially last up to ten days. Your transport is scheduled for a particular week and not a particular day. Our transport week consists of 10-14 calendar days. While a seven to ten day transport is rare, it can occur, and all efforts are made to keep your pet(s) comfortable throughout the transport. Pro Pet Transports is a 24-hour transport company and while every effort is made for our drivers/attendants to arrive at a convenient time, schedules may dictate arrival at any hour day or night. Customers are provided with the estimated pickup and delivery dates. It is important to note that these dates are estimates only and situations beyond our control can create delays. If delays (or advances) are significant, affected customers are called and updated with the revised estimated date of arrival.
V. Animals: ____________ (Initial)
We cannot transport animals that have a tendency to be aggressive or vicious. If our attendants examine your pet(s) and determine that transportation of the animal(s) would be dangerous to either the animal(s) or the attendants, we reserve the right to refuse this transport. In addition, we will not transport any animal wearing a muzzle or other restrictive device. If your animal becomes aggressive during the transport, it may become necessary to leave them in their carriers for part or even all of the transport (for everyone's safety and comfort).
VI. Animal Carriers: ____________ (Initial)
It is important that the animal being transported be in an APPROPRIATE CARRIER. If a bird is being transported there must be a perch correctly sized for the bird. There must also be adequate room to accommodate the birds head and tail feathers. PPT is bound by USDA regulations and wire cages are not allowed for either cats or dogs. All animals must have room inside of the carrier to be able to sit, stand, turn and lie down comfortably inside the carrier. We reserve the right to deny service to anyone not complying with these standards. Carriers being supplied by the customer must be in good repair, doors must close and latch properly. If a carrier provided by the owner is not the stated size, the change in size will be reflected in the total charges.
VII. Insurance: ____________ (Initial)
It is understood that, unless additional insurance is purchased, the animal(s) PPT transports are only covered for $100 per carrier or cage. This insurance will cover the animal(s) if they are lost, stolen or killed while in our care. This does not cover acts of God, illnesses acquired prior to the start of the transport or after delivery, acts of war or terrorism or any other incidents not directly related to our transport. It is highly recommended by our company that additional insurance is purchased as the basic insurance does not cover THE COST OF TRANSPORTING ANY ANIMAL(S).
IIX. Miscellaneous Provisions: ____________ (Initial)
Oregon law will govern this contract and all rights, obligations, and disputes arising out of it. This contract, for all purposes, has been deemed to be executed in the State of Oregon as the principle place of business of Pro Pet Transports, Inc. It is agreed that the rights of the parties under this contract shall be governed by the laws of the State of Oregon without reference to conflict of law principles. It is further agreed that any action against Pro Pet Transports, Inc., whether or not arising out of the provisions of this contract shall be brought in the state or federal courts located in or for the state of Oregon, County of Grant, or the United States District Court for the District of Oregon, and each party consents to the jurisdiction of such courts and waives objections to jurisdiction, venue and convenience of forum. Pro Pet Transports, Inc. and all parties to this contract each waive any right to a jury trial in such proceedings.
IX. Rescheduling: ____________ (Initial)
In the event that you find the need to reschedule your transport within 120 hours of the start of the transport, you will be charged a rescheduling fee of 25% of the total cost, not to exceed $100. Rescheduling prior to 120 hours before the commencement of the transport will incur no additional charges. Please contact our office as soon as you know of a change of plan. All customers wishing to reschedule a transport must receive a rescheduling confirmation number from our office in order to verify that the transport will be rescheduled.
X. Cancellation: ____________ (Initial)
Cancellations must be made no later than close of business (5:00 PM PST) of the Friday before the start of the transport. It is understood that "the start of the transport" is when our transport vehicle leaves from the main office in Eastern Oregon, Not when we are scheduled to pick up your pet/s. Cancellations made within 120 hours of the start of the transport will be charged a cancellation fee of 25% of the total cost, not to exceed $100. If you cancel after 5:00 PM PST of the Friday before the start of the transport, you will be charged the full transport fee and will only be refunded the cost of any additional insurance, carrier rental fees and/or any accessories purchased. All customers wishing to cancel a transport must receive a cancellation confirmation number from our office in order to verify that the transport will be cancelled.
Last Minute Additions: A last minute addition is considered to be any transport booked within 120 hours of the start of the transport and is Non-Refundable.
BY SIGNING BELOW AND BY USING OUR SERVICES YOU ARE STATING THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY ALL THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT. I have been informed that the "start of the transport" is when the vehicle leaves from the main office in Eastern Oregon, not when my pet/s are scheduled to be picked up. If I am not sure when the start of the transport is, or have other questions regarding these terms & conditions, it will be my responsibility to call the office for more information.
